Dubai RERA Law Updates: What Real Estate Businesses Need to Know

Dubai’s property market keeps growing, and the compliance side is getting tighter with it. For brokerages, developers, property managers and real estate marketing teams, knowing the basic RERA registration process is no longer enough. You also need to track Dubai Land Department circulars, federal compliance rules and the digital systems now used to regulate day-to-day activity.

The latest Dubai RERA law updates are not contained in one single law. They include new 2026 circulars, older laws being reinforced, advertising controls, rental-index changes and a newer federal anti-money laundering framework.

If you run a real estate business in Dubai, the practical question is simple: what has changed, and what should you do differently?

  1. Cold Calling Is Now a Bigger Brokerage Compliance Risk

One of the clearest 2026 developments is DLD’s circular titled “Regulations Governing Communication with Property Owners and the Prohibition of Cold Calling,” published on 27 February 2026. DLD lists it among its current licence circulars. The wider UAE telemarketing framework also requires companies to use properly registered numbers and generally limits marketing calls to 9:00 am to 6:00 pm.

For agencies that still depend heavily on cold outbound calling, this should trigger an immediate review. Lead generation should be built around documented enquiries, referrals, portal leads, approved campaigns and other contact routes that can be traced.

Your CRM should record where the lead came from, which agent contacted the person and whether the customer asked not to be contacted again.

DLD has taken action against cold calling before. In a 2022 enforcement case, RERA fined a brokerage AED 50,000 and suspended nine brokers for three months. That case predates the 2026 circular, so it should be read as an example of enforcement rather than a current penalty schedule.

If you are reviewing your brokerage structure, Nexture’s guide to the RERA broker licence in Dubai explains the company and professional registration steps.

  2. Off-Plan Marketing and Escrow Checks Need to Happen Before Promotion

Dubai Law No. 8 of 2007 has long required developers selling off-plan units to use project-specific escrow accounts. Recent RERA activity has put renewed attention on compliance.

DLD published a circular on 8 January 2026 concerning compliance with the escrow-account law. It had already issued another circular in March 2025 dealing with compliance with Law No. 8 of 2007 when marketing real estate projects.

For brokers and developers, the operating rule should be simple. Do not market an off-plan project until you have verified that the project is registered with DLD, the required escrow account is in place and the necessary marketing permit has been issued.

The underlying law requires project-specific escrow arrangements, while DLD’s current project-registration service connects real estate project registration with the process of opening an escrow account for off-plan sales.

A sales brochure, developer WhatsApp message or internal price sheet is not enough proof on its own. Check the project through official DLD systems before your team publishes listings, runs ads or accepts buyer interest.

  3. The Smart Rental Index Still Drives Rent Increase Decisions

The Smart Rental Index launched in January 2025 and remains central to Dubai’s rental system in 2026. It uses building classification and market information to provide a more detailed assessment of rental values.

The legal rent-increase bands themselves are older. Decree No. 43 of 2013 still sets the maximum increase at renewal.

Current rent compared with average market rent

    Maximum increase

    Up to 10% below average

    0%

    11% to 20% below average

    5%

    21% to 30% below average

    10%

    31% to 40% below average

    15%

    More than 40% below average

    20%

DLD also states that where a landlord wants to increase rent, the tenant must receive notice at least 90 days before the contract expires, and the property must still qualify for an increase under the applicable index.

Property managers and landlords can check the official Dubai Rental Index service before calculating a renewal.

For a property management company, the index check and notice date should sit inside the renewal workflow. Keep the calculation and the notice record on file. Do not use asking prices from property portals as a replacement for the official DLD rental tool.

  4. Advertising Compliance Starts Before the Listing Goes Live

RERA’s advertising system now gives buyers a direct way to verify approved advertisements. Madmoun generates a QR code for real estate advertising permits issued through the Trakheesi system. The QR-code requirement became mandatory in April 2023.

DLD has continued tightening digital ad monitoring. Its advertising governance platform uses automated monitoring to check listings and marketing material against regulatory requirements.

The official DLD Real Estate Ad Permit service covers online advertisements, classified listings, SMS, billboards, open houses, promotional campaigns, seminars, project launches and real estate exhibitions.

For a brokerage, the internal rule should be strict: no property ad goes live until the team has the correct permit details and required QR verification.

This applies to social media and messaging campaigns too. A quick Instagram post or bulk WhatsApp message is still marketing activity.

  5. AML Compliance Now Sits Under a Newer Federal Framework

Real estate brokers and agents involved in buying and selling property fall within the UAE’s Designated Non-Financial Businesses and Professions, or DNFBP, framework. That brings anti-money laundering duties into normal real estate operations.

The UAE now lists Federal Decree-Law No. 10 of 2025 and Cabinet Resolution No. 134 of 2025 as the current core AML framework. The Ministry of Economy and Tourism also continues to require in-scope real estate firms to register through goAML.

For real estate businesses, this means proper customer due diligence, beneficial-owner checks, sanctions screening, transaction monitoring, record-keeping, and reporting where required.

The Ministry’s current AML FAQ also refers to real estate activity reporting for specified transactions and states that transactions exceeding AED 55,000 in the relevant reporting context are submitted through goAML.

In practical terms, your compliance file should be able to answer four questions quickly: who is the buyer, who ultimately owns the purchasing company, where the funds came from and whether any sanctions or unusual-payment risks are present.

Collecting a passport and Emirates ID is not enough if the ownership and source-of-funds picture is still unclear.

  6. DLD Is Moving Developer Compliance Into More Connected Digital Systems

On 3 September 2026, Dubai Land Department launched its Initial Registration platform for developers. It brings project registration, real estate transaction registration and escrow-account management into a more connected digital process.

This is mainly an operational change, but businesses should take it seriously. Project names, unit details, buyer information, payment schedules and escrow records need to match across internal sales systems, contracts and DLD submissions.

The direction also fits the Dubai Real Estate Sector Strategy 2033, which puts strong emphasis on data integration, transparency and digital services.

  7. Broker Cards, Staff Registration and Activity Licensing Still Need Routine Checks

A brokerage trade licence does not automatically allow every employee to act as a broker. DLD states that brokers must be registered in the brokers registry and hold the relevant broker card. Card validity is connected to the company licence, and renewal requires the applicable continuing education documentation.

DLD also has separate licensing requirements for activities such as brokerage, development, valuation, property management and jointly owned property management. Some activities carry additional conditions. For example, DLD currently states that companies licensed to lease and manage third-party properties must provide an AED 5 million bank guarantee.

A simple compliance calendar can prevent avoidable problems. Track the company licence, broker cards, continuing education, authorised phone numbers, Trakheesi access and permit expiry dates in one place.

What Real Estate Businesses Should Check Now

    Business type

    Immediate check

    Brokerage

Lead sources, calling practices, broker cards, registered numbers and advertising permits

    Developer

Project registration, escrow status, marketing permits and buyer-payment processes

    Property manager

Smart Rental Index checks and 90-day notice controls

    Marketing team

Trakheesi permit confirmation and Madmoun QR details before publishing

    Compliance team

AML policies, goAML access, CDD, beneficial ownership, sanctions and source-of-funds checks

    Management

Evidence of staff training, internal controls and periodic compliance reviews

The main mistake is treating RERA compliance as something that matters only at licence renewal. The current rules affect daily work: who your team calls, what they advertise, which projects they promote, how rent increases are handled and what client information must be checked.

Conclusion

The Dubai RERA law updates affecting businesses in 2026 point toward tighter marketing controls, more traceable transactions and stronger digital compliance.

Brokerages should review cold-calling practices now. Developers need escrow and off-plan checks before campaigns begin. Property managers should use the Smart Rental Index correctly, and firms involved in property transactions need to treat AML checks as a core operating requirement.

Dubai remains an active real estate market, but informal processes create more risk than before. Build the checks into sales, marketing and compliance workflows early.
