You have chosen a business name, bought the domain and started working on the logo. Before you spend more on packaging, signage or a trademark application. It is important to check whether the brand is actually available.

A trademark search in the UAE helps you identify registered or pending marks that could conflict with your proposed name or logo. It can also reveal another issue. Your mark may be available but still difficult to register because it is descriptive, misleading or contains a protected sign.

The UAE Ministry of Economy and Tourism makes an important point on its current inquiry page. A search result does not mean the later trademark application will automatically be accepted.

What Is a Trademark Search in the UAE?

A trademark search checks whether your proposed brand may conflict with earlier trademark rights.

UAE trademark law allows distinctive signs such as names, words, letters, symbols, drawings, packaging, colours and certain non-traditional marks to be registered. It also recognises certain sound and smell marks. At the same time, the law restricts marks that lack distinctive character, misuse protected symbols or fall within other prohibited categories.

A useful search therefore asks two questions:

  1. Is someone else already registering or using something too close to my mark?

  2. Is my mark itself likely to face an objection?

That is more useful than searching for one exact word and stopping there.

A trade name identifies the legal business on its commercial licence. A trademark protects the brand used to distinguish goods or services.

For example, your company could be licensed as North Coast Food Trading LLC while selling coffee under Noma Roast. Reserving the company name does not automatically protect Noma Roast as a registered trademark.

How to Check Trademark Availability in the UAE

  1. Define the Exact Mark

    Start with what you plan to protect:

    • Brand name

    • Logo

    • Slogan

    • Combined word and logo

    • Product or service sub-brand

    Do not search only the legal company name if customers will see a different brand.

    A word mark and a logo can also produce different search results. A word search focuses heavily on spelling, sound and meaning. A logo search needs to consider visual similarities too.

  2. Identify the Correct Trademark Class

    Trademark applications use the Nice Classification for goods and services. The classification contains 45 classes.

    You can check the latest classifications through the WIPO Nice Classification database.

    The class matters because conflict risk depends heavily on the goods or services involved. A similar name used for unrelated products may present a different issue from two competing brands selling the same type of product.

    Do not choose a class because the heading sounds close. Check the actual goods and services you intend to sell.

  3. Run the Official UAE Trademark Inquiry

    The Ministry of Economy and Tourism provides an Enquire About Registration of Trademarks service.

    As of August 2026:

    • Fee: AED 350

    • Result: Immediate

    • Channel: Ministry website or smart app

    • Required documents: None listed on the current service page

    The Ministry also states that the inquiry result, whether a match appears or not, does not imply acceptance of a later trademark registration application.

    That distinction is important. The inquiry is a pre-filing check. The actual application still goes through examination.

  4. Search More Than the Exact Spelling

    If your proposed mark is Klyro, do not search only Klyro.

    Check close alternatives such as:

    • Kliro

    • Clyro

    • Similar sounding names

    • Spacing changes

    • Singular and plural forms

    • Shortened versions

    • Similar Arabic transliterations where relevant

    • Logos with similar visual elements

    WIPO advises applicants to check marks that may be similar in appearance, sound or meaning, rather than limiting the search to exact duplicates.

    This is where a lot of DIY searches become too narrow.

  5. Check the Goods and Services Behind Each Result

    A search result becomes more important when the earlier mark covers the same or closely related products or services.

    Suppose you want Mira for skincare. An earlier Meera trademark covering cosmetics deserves much closer attention than a similar mark covering industrial machinery.

    Check:

    • Trademark class

    • Exact goods and services

    • Owner

    • Filing date

    • Registration date

    • Application or registration status

    Do not rely on the class number alone. Read what the registration actually covers.

  6. Search WIPO's Global Brand Database

    WIPO's Global Brand Database provides a useful international search layer. It covers international registrations under the Madrid System as well as records supplied by participating national and regional trademark offices.

    You can search by:

    • Brand name

    • Owner

    • Goods and services

    • Registration number

    • Image similarity

    • Country and other filters

    WIPO's current pre-filing guidance says its search environment covers more than 50 million records from over 70 databases. WIPO still advises applicants to check relevant national or regional registers because a global database should not be treated as complete.

  7. Check Whether the Mark Itself Is Registrable

    A name can appear clear in a database and still face rejection.

    Federal Decree-Law No. 36 of 2021 restricts marks that, for example:

    • Lack distinctive character

    • Merely describe the goods or services

    • Offend public morals or public order

    • Misuse flags, state symbols or protected official signs

    • Use Red Crescent, Red Cross or similar protected symbols

    • Use certain religious symbols

    • Use geographical references in a way that may cause confusion

    • Use another person's name, photograph or similar identifier without the required approval

    So treat available and registrable as separate checks.

UAE trademark law can protect registered marks against the same or similar marks used for similar goods or services where consumer confusion is likely.

That is why a proper clearance search goes beyond exact wording.

If the results look acceptable, you can move to filing.

An expedited one-business-day examination is also available for AED 2,250 instead of the standard AED 750 examination fee.

After acceptance, the mark is published in the Ministry's electronic trademark bulletin. Interested parties have 30 days from publication to submit an objection.

Common Trademark Search Mistakes

Searching Only Google

Google can reveal businesses already using a similar name. It does not replace an official trademark search.

Checking Only Exact Matches

Small spelling, sound or visual differences can still create a conflict.

Ignoring Pending Applications

A pending application may later become registered and affect your proposed filing.

Searching the Wrong Class

A clean result in the wrong class tells you very little about the goods or services you actually want to protect.

Assuming a Trade Name Protects the Brand

Company licensing and trademark registration are separate systems.

Should You Search English and Arabic Versions?

If the brand will appear in both languages, search both.

Consider transliterations, common spelling variations and how customers are likely to pronounce the brand.

Two names can look different when written down while sounding very close in conversation. That becomes relevant when you assess whether customers could confuse one brand with another.

When Is a Professional Clearance Search Worth It?

A basic search may be enough to remove clearly unavailable names from a shortlist.

A more detailed review is sensible when:

  • You plan substantial marketing spend

  • You are launching consumer products

  • You want to franchise

  • You plan to enter several countries

  • Similar earlier marks appear in the results

  • Your brand contains common or descriptive wording

  • You are buying an existing brand

  • Rebranding later would be expensive

The goal is simple. Find possible conflicts before the market, packaging and advertising are built around the name.

Conclusion

A trademark search in the UAE should happen before filing and ideally before you commit serious money to the brand.

Identify the exact mark and classes. Run the Ministry inquiry. Search spelling, sound and logo variations. Review related goods and services. Then use WIPO's database for a wider check.

Most importantly, do not treat a clean search as approval. The Ministry still examines the trademark application under UAE law and third parties have an opportunity to object after publication.

A careful search gives you a much better basis for deciding whether to file, revise the brand or choose another name.
