Starting a new UAE job often comes with probation. It lets the employer assess your performance and gives you time to decide whether the role matches what was promised.

Probation does not remove your legal rights. Your employer must pay the agreed salary and follow the correct notice procedure.

Article 9 of Federal Decree-Law No. 33 of 2021 sets the main probation period rules for UAE private-sector employment. The rules differ depending on whether the employer terminates the contract, you move to another UAE employer or you leave the country.

What Is a Probation Period in the UAE?

A probation period is an agreed trial period at the beginning of employment. It should appear in the employment contract along with the start date, job title, wage, workplace and other key terms.

The federal rules apply to mainland private-sector employment and may operate alongside the regulations of the relevant free zone. DIFC and ADGM have separate employment frameworks. Domestic workers, government employees, members of the armed forces, police and security services also fall under different laws.

How Long Can Probation Last in the UAE?

Can an Employer Terminate an Employee During Probation?

Yes. An employer may terminate the contract during probation by giving at least 14 days’ prior written notice.

The employer should state the termination date clearly and keep proof that the employee received the notice. If work stops immediately, the notice obligation may require payment.

The employer must also settle earned salary and other payable entitlements. UAE law requires final employment dues to be paid within 14 days from the end of the contract.

Probation does not permit an employer to withhold earned wages, charge unlawful recruitment fees or ignore general worker protections.

Resigning to Leave the UAE

If you are ending the contract during probation to leave the country, you must normally provide at least 14 days’ written notice.

If you return to the UAE and obtain a new work permit within three months of departure, the new employer may have to compensate the previous employer for recruitment or contracting costs unless an alternative agreement applies.

Do not disappear from work or leave without completing cancellation formalities. This can lead to an absence complaint, delayed cancellation or a possible one-year work permit restriction in situations covered by the law and MOHRE rules.

What Happens If the Required Notice Is Not Given?

If either party ends the contract without following Article 9, the breaching party may have to compensate the other party.

The amount is equal to the employee’s wage for the full notice period or the unserved part of that period.

For example, suppose an employer gives only four days of notice instead of the required 14 days. The employee may be entitled to compensation corresponding to the remaining 10 days, subject to the facts and the wage basis applied.

Salary, Leave and Benefits During Probation

Salary

An employee must receive the salary stated in the employment contract. Probation is not a reason to delay wages, reduce agreed pay or make unauthorised deductions. The UAE Government provides separate wage-payment guidance.

Annual Leave

Under the official annual leave rules, the statutory entitlement generally begins once service exceeds six months. Employees with more than six months but less than one year receive two days for each month of service. After one year, the entitlement is 30 days per year.

An employer may agree to grant annual leave during probation, subject to approval.

Sick Leave

Under the official sick leave rules, an employee is not entitled to paid sick leave during probation. The employer may grant unpaid sick leave if an approved medical report supports it.

Public Holidays and Weekly Rest

Probationary employees remain covered by the applicable rules on paid public holidays, working hours and weekly rest.

End-of-Service Gratuity

For expatriate full-time workers under the standard gratuity system, end-of-service gratuity generally requires at least one year of continuous service. Since probation cannot exceed six months, a worker whose employment ends during probation will normally not qualify.

The employee must still receive salary up to the last working day and any other contractual or statutory amount that has become payable.

Can a Work Permit Ban Apply After Probation Resignation?

The UAE Government’s page on a one-year work permit restriction explains that a restriction can arise in certain cases involving termination, absence or departure. Article 9 addresses a foreign worker who leaves the UAE without following its probation requirements.
